  1. 01 Brainstorm brand namesBuild a short list of names that are distinctive, memorable, and flexible enough to grow with the business. Stronger names usually do more work than descriptive ones.
  2. 02 Start with a preliminary searchSearch the USPTO database, the web, domains, and social platforms for obvious matches. Treat this as an early screen, not a final clearance decision.
  3. 03 Complete comprehensive clearanceLook beyond exact matches for similar sound, spelling, meaning, commercial impression, and related goods or services. A conflict can be close without being identical.
  4. 04 Choose word mark or logo strategyDecide whether the priority is protecting the name itself, the particular logo design, or both. A word mark and a logo protect different things.
  5. 05 Identify the correct ownerConfirm whether the owner will be an individual, LLC, corporation, or another entity before filing. The application should match the business that actually owns the brand.
  6. 06 Select goods and services carefullyDescribe what the brand offers now, and what the business genuinely plans to offer. The right identification creates useful protection without overreaching.
  7. 07 Document use or intent to useGather dates, labels, packaging, website pages, sales materials, and other evidence showing how the mark is used. If launch is ahead, assess an intent-to-use filing.
  8. 08 Set the filing strategyChoose the application basis, classes, timing, and filing order that fit the brand’s stage and budget. A filing plan should support the next phase of growth.
  9. 09 Plan to monitor the markDecide how you will watch for confusingly similar filings, marketplace use, and new competitors. Registration is a foundation; protection also requires attention.
  10. 10 Calendar renewal and ongoing protectionTrack USPTO maintenance and renewal deadlines, keep evidence of current use, and revisit the strategy when the business expands, licenses, or changes direction.
